  1. “Services” hereby refers to the services offered by Meca Gaming Pty Ltd Trading as Arcade Machines Australia
  2. “Website” or “this Website” hereby refers to www.arcademachines-australia.com.au
  3. “Terms and Conditions” hereby refers to the provisions outlined in this document
  4. “User” hereby refers to a person who makes use of this Website in any way or form.
  5. “Customer” hereby refers to a person who orders Product(s) via this Website or in person/store
  6. “Product(s)” hereby refers to any products listed as shopping items on this Website or in store

Introduction

www.arcademachines-australia.com.au is a website run by Meca Gaming Pty Ltd Trading as Arcade Machines Australia (AMA)

The provision and use of this Website are subject to the following Terms and Conditions. By registering as a User of the Website and/or commitment through a contractual sale you agree that:

  1. you have read and understand these Terms and Conditions; and
  2. you will comply with these Terms and Conditions in your use of the Website and the Services.

 

Consumer Guarantee's


You may be entitled to a remedy under the Australian Consumer Law if you believe an item is defective. The change of mind policy has no bearing on these rights, and they are not subject to a time limit. The Australian Consumer Law does acknowledge,
however, that the relevant time period varies by product (or service), depending on the nature of the goods (or service), the price paid, and any representations made about the goods (or service).

 

 

Warranty Terms

The warranty terms for each Product will appear on the product page for that particular product. Warranty terms vary for the different styles of Product(s) available.

All warranty claims are “back to base” which means that if you purchase a product from MECA GAMING Pty Ltd Trading as Arcade Machines Australia and it fails during the warranty period you need to return the goods or faulty item back to Arcade Machines Australia (at your cost) – MECA GAMING Pty Ltd Trading as Arcade Machines Australia will then repair/replace with new and return back to you (at our cost).
If there is a problem with a product(s) we will repair it (or, at our discretion, replace it) as soon as possible, if under manufacturer’s warranty, if the fault is identified by MECA GAMING Pt Ltd Trading as Arcade Machines Australia, the manufacturer, or their service agent, Arcade Machines Australia will not be able to provide a refund, exchange, or repair if an item is damaged due to misuse or abnormal use. Prior to providing a remedy under the Australian Consumer Law, Arcade Machines Australia will require satisfactory proof of purchase.

All products much be returned back to MECA GAMIMG Pty Ltd for any warranty repairs, unless pre-arrangements were made between customer and Arcade Machines Australia.

 

THE WARRANTY DOES NOT APPLY TO

  1. Improper Care
    Please take care to treat your Machine like the high quality product it is. Proper care and use are essential to preserving your rights under this warranty. MECA GAMIMG Pty Ltd Trading as Arcade Machines Australia will not repair or replace parts if improper maintenance or improper use causes damage. This warranty does not apply if your Arcade Machine product is damaged by the use of detergents, abrasives, or other harsh cleaning agents.
  2. Accidents, Abuse, or Normal Wear and Tear
    Defects judged by MECA GAMING Pty Ltd Trading as Arcade Machines Australia to be the result of normal wear and tear, accidental damage, alteration, misuse, abuse (including burning, scratches, scuffs, dents, chips, marks, accidental breakage, normal wear and tear or watermarks), neglect,  improper installation, placing the product in an outdoor area or natural calamity are not covered under this warranty.
  3. Glass Table Top
    This warranty does not cover the Glass Table Top from scratches or breakage once supplied
  4. Subsequent owners: MECA GAMING Pty Ltd Trading as Arcade Machines Australia extends this warranty to the original and first owner however does not extend to subsequent owners.
  5. Commercial, rental trade, institutional or other non-residential use: This warranty does Cover the afore mentioned business types
  6. Demonstration tables, floor samples (unless proven structurally defective, the definition of which does not include nicks, dents, scratches, gouges and flaws resulting from daily wear and tear due to being a floor sample or resulting from disassembly and reassembly of the floor sample), pre-owned products (other than as expressly set forth herein) and non-commercial tables used in an institutional or commercial setting;
  7. Consumable Heavy contact items such as Joysticks and buttons are supplied with full warranty however damage and misuse will void warranty.
  8. Damages incurred during handling and transportation of the product by the customer or their contractor.
  9. Labour charges and related expenses for removal, installation or replacement of the product or components in non-standard living /commercial or industrial environments are not covered under this warranty.
  10. MECA GAMING Pty Ltd Trading as Arcade Machines Australia reserves the right to decide whether a component should be repaired or replaced

 

Terms and Conditions of Sales

Placing an order via this Website, in store or over the phone/email the Customer makes an offer to purchase the Product(s). By placing an order, the Customer enters into a binding contract between themselves and MECA GAMING Pty Ltd Trading as Arcade Machines Australia.

By placing an order on this Website or instore the stock ordered by the Customer will be automatically reserved for them. This stock will be reserved for the Customer for three (3) days, or longer if agreed upon between customer and MECA GAMING Pty Ltd. It is the Customers responsibility to make payment for the item during this time. If payment for the order has not been received after this time, the stock will be released and will no longer be exclusively reserved for the Customer.

When making an inquiry about a Product(s), the stock will not be reserved for you. Making an inquiry allows MECA GAMING Pty Ltd sales team to contact the Customer to provide further details about the Product(s).

For Products not currently in stock customers are required to make an initial payment of no less than 50% of the total purchase price in order to secure a Product. Full payment must be made once the Product(s) is ready to be shipped or picked up in store. This is a non-refundable deposit.

All Custom-made products will require and 50% non-refundable deposit before any work is commenced as these products are custom to you and you only and take a significant amount of time to build and design, no change of mind will be accepted.

By placing an order and paying the 50% deposit you are agreeing to these terms and conditions above.

Further more build times of 15-18 weeks per build from the time of full payment is an estimate only and Meca Gaming Pty Ltd is not responsible for any external parties or factors that will prolong build time and there for the machine getting build will so as soon as we can.

Ordering Restricted Goods

 

“Restricted Goods” means products which are only intended to be viewed, played, listened to or otherwise utilised by a person of at least a certain age


Sale of Restricted Goods is subject to various Commonwealth, State and Territory laws. By placing an order for any Restricted
Goods you warrant to MECA GAMING Pty Ltd that you are:

 

  • 18 years of age or older, where you order products that are classified R18+;
  • 15 years of age or older, where you order products that are classified MA15+.
     

When placing an order for Restricted Goods you warrant that you are not obtaining the Restricted Goods on behalf of a person
that is not eligible to purchase the Restricted Goods themselves.


We may request Commonwealth, State, or Territory issued identification from you to verify your eligibility to order Restricted
Goods.


You are making an offer and a commitment to purchase products, services, or both in accordance with these Terms and Conditions by placing an order through our Website or in store (Order). Your Order may be accepted or rejected at our sole discretion.


Following the completion of your Order on line, you will receive an email confirming the details of your Order as well as payment
receipt (where applicable). Additional notification emails will be sent to you, including but not limited to:

  • Any communication from us regarding your Order;
  • Requests to verify your payment;
  • Notification that your Order has been accepted or rejected;
  • Notification that your Order is ready for collection or has been dispatched;

Regardless of whether your credit card has been charged or we have received payment from you, we may accept, decline, or
limit your Order at any time after receipt for any reason. If your credit card has been charged or we have received payment
from you and your Order is cancelled by us, we will issue you a refund.

 

Payment

Orders can be paid for online with VISA and MasterCard and most other credit cards, PayPal, direct deposit, Afterpay and Zip Money.


All credit card transactions are subject to a 2.9% credit card surcharge on the order value. A 3% surcharge on the Order's value is applied to all PayPal transactions. Either the billing or shipping recipient must be the credit card holder. Afterpay and Zip Money are subject to a 6.5% surcharge

 

Afterpay can be used up to the amount of $2000, with a 6.5% surcharge

Zip Money can be used up to the amount of $5000, with a 6.5% surcharge

 
Credit Card transactions may be subject to additional payment verification processes, which could cause your order to be
delayed. To ensure the quickest despatch times, we recommend paying for your order with a verified PayPal account.

 

If we are unable to successfully process your credit card payment, or you are unable to verify payment for your Order, we
reserve the right to reject or cancel your Order. You must not pay for Orders in any fraudulent or unlawful manner, or attempt to do so.
 

At the time of delivery or in store (where applicable), we will give you a receipt that details the total fees and charges for the products and services in your Order.
 

The Australian Dollar ($AUD) is used to process all transactions.
 

All payments made through the Website are the responsibility of Arcade Machines Australia. In accordance with these Terms and Conditions, this responsibility includes refunds, chargebacks, cancellations, and dispute resolution.

Amex is not accepted online or in store.


Pricing and Availability


All prices are in Australian Dollars (AUD) and include GST. We reserve the right to change prices and product and service offerings at any time for any reason without any notice.


We reserve the right to accept, decline, or limit any Orders placed if there is an error on our website, such as a product listed at an incorrect price or with incorrect specifications.


Any product availability information we provide is provided as a guide only and is subject to change without notice. We will not be held responsible if products ordered through the Website are not available.

 

Delivery Address

During the Checkout process, it is the Customers responsibility to ensure that the correct Billing Address and correct Shipping Address are entered. Product(s) will be delivered to the delivery address provided by the Customer, the Seller is not, and shall not be held responsible for any Product(s) not received by the Customer due to incorrect Shipping Address.

Freight Options

It is the Customers responsibility to select the appropriate freight option for their Order during the Checkout process. The Seller shall not be held responsible for any problems arising from the selection of an inappropriate freight option for the Customers particular situation.

Delivery

All Product(s) will not be shipped until full payment from the Customer for the Product(s) has cleared. The Seller will under no circumstance ship any Product(s) before payment has cleared. Any dates quoted by Seller for the delivery of Product(s) are estimates only and shall not form part of the contract. Seller aims to deliver promptly, however delays are occasionally inevitable due to unforeseen factors. Seller shall be under no liability for any delay or failure to deliver the Product(s) within the estimated delivery time. Please allow 5-6 weeks for all custom orders.

Due to OH&S concerns, customers are required to be available at the point of delivery to assist the driver. Additional charges will apply if a ‘two person delivery’ or a ‘tail gate truck’ is required.

Taxes and Other Charges

The Seller will not be responsible for any tariffs, customs restrictions, customs clearance, and other applicable taxes. Please note that often there are costs associated with documents (Original Bill of Lading, Certificate of Origin, etc…) and all costs will be also be paid by the Customer.

It is the responsibility of the Customer to pay the charges levied by the authorities and observe the respective regulations of the country in which he or she receives the Product(s).
